Grounds for divorce

In order to obtain a divorce in England and Wales you must have been married for at least one year and be able to show the court the marriage has broken down. In order to do this you will need to rely on one of the following facts:

  • Your spouse has committed adultery and you can no longer live with them
  • Your spouse has behaved unreasonably towards you and you can no longer live with them
  • Your spouse has deserted you (left without your consent) for two years or more
  • You and your spouse have been separated for two years or more and your spouse agrees to the divorce
  • You and your spouse have been separated for five or more years

The majority of divorces are undefended as generally both parties accept the marriage has broken down and come to understand that the grounds for divorce will have little effect on financial matters and the arrangements for the children.

From the date the proceedings are issued, an undefended divorce will usually take between four and six months to the pronouncement of Decree Nisi. There is then a further six week period before the application can be made for Decree Absolute to end the marriage. This can sometimes be delayed until financial matters are resolved.

When dealing with a divorce, it is important to put in place a court order dealing with the financial position to prevent further financial claims being raised by either party in the future, for more information click here.
