What is the deadline to appeal a decision made in the family court?

The family team at George Green Solicitors, notably Mark Vandaele and Aimee Stokes, have recently had success at appealing a high-net-worth financial order at the Royal Courts of Justice.

 

The road to a successful appeal is a long one, however the application must be lodged swiftly in order to begin the appeal process. To appeal a final order, the deadline is 21 days and for a case management (or interim) decision, the deadline is 7 days.

 

If you are unable to comply with the deadline, you would need to apply for permission to appeal out of time and seek to justify to the Court the reasons why your appeal was lodged late. It would be up to the Court’s discretion to consider the appeal application out of time or not, there is no guarantee an application will be considered when filed late.  However if you find yourself in that circumstance, do consider contacting our family team who can advise on any potential merits.

 

After the appeal application is lodged, the Court will consider whether to grant or refuse permission to appeal, and on which grounds the appeal will be allowed to proceed upon (if any). If permission to appeal is granted, then an appeal hearing will be listed whereby you should consider appointing expert legal representation.
