George is a partner in our commercial litigation team. He has over 10 years’ experience in high value and contentious litigation.
He is recognised by the legal guides as a talented and leading litigator noted for his focus on shareholder, insurance and construction disputes. The legal directories have described him as "very effective, popular with clients” and someone who runs “serious commercial litigation.” Clients report to being “very impressed” and say that George’s “wisdom, professionalism and communication is first-class.”
He has experience in contested and complex litigation, representing clients at court, in adjudications and in mediations. He has represented clients in the Court of Appeal, in the Technology and Construction Court, in the High Court (Business and Property Courts) and in the Commercial Court.
Example corporate disputes work
- George advises on and represents clients in unfair prejudice petitions, derivative actions, earn out claims, breach of share purchase agreements, director’s disqualification proceedings and breach of fiduciary duties.
- Represents a petitioner in a classic unfair prejudice case, in which the petitioner has been improperly excluded from a business and terminated as a director. The rogue director is also being pursued for breach of director’s duties. The case has overlapping employment issues.
- Patel v Parker [2023] EWHC 1979 (Ch) Acting for the defendant in proceedings arising out of a corporate joint venture concerning the development of a bariatric hospital. The case involved complex disclosure issues and expert evidence. After several years of heavily contested litigation, the case settled on day 4 of a trial originally listed for 5 weeks.
- Gill v Thind [2023] EWCA Civ 1276 Successful defence in the Court of Appeal following a three week trial of three unfair prejudice petitions and related claims concerning the ownership and management of three companies. The claimant was refused permission to challenge the Court of Appeal’s decision at the Supreme Court.
- Gill v Thind [2022] EWHC 2872 (Ch) Successfully represented clients in the Business and Property Courts in a complex and high value corporate dispute and unfair prejudice petition concerning the ownership of and alleged mismanagement of several companies. - Represented the sellers in a seven-figure dispute concerning the terms of a share purchase agreement and the earn-out consideration due under that agreement. George negotiated a substantial payment from an international company for the sellers.
- Represented a client bringing a claim for over £2m for breaches of a share purchase agreement and loan agreements. The dispute successfully settled shortly after we issued proceedings.
Insurance work
- George is noted in the legal guides for his work on insurance disputes generally. George regularly contests insurance declinatures arising from building insurance, contents cover, commercial liability insurance and life and critical illness policies.
- Acted for a high-net-worth individual who claimed on an insurance policy following the theft of expensive jewellery and gold. The insurer declined to honour the policy and accused the individual of insurance fraud. George issued proceedings against the insurer for breach of the policy. The insurer paid out in full (costs included) shortly before trial.
- Acted for a sole trader in a dispute with a well-known insurer. The sole trader was working on a building site where a fire commenced and was accused of being responsible for the incident. The insurer declined to cover him for alleged breaches of the policy conditions.
- Regularly acts for individuals and businesses who are complaining to the Financial Ombudsman Service. Where insurers ignore the decisions of the Financial Ombudsman Service, George has successfully converted the decisions into court orders for enforcement purposes.
Civil fraud
- Acts for a limited company and its director in a complex multi-party dispute involving allegations of fraud arising from a disputed £6M loan transaction. The case is proceeding in the Commercial Court.
- Acts for a property investment company advancing claims in the Circuit Commercial Court for deceit and breach of Quistclose trusts.
- Experience defending companies accused of causing loss and being liable for the loss under the tort of deceit.
- Patel v Parker [2023] EWHC 1979 (Ch) This dispute arose from a corporate joint venture. George acted for the defendant in this corporate dispute to a variety of claims, which included wide ranging allegations of fraud. The case was heavily contested. Allegations between the parties included deceit, document manipulation and forgery.
Example construction work
- Magnetic Shields Limited v Vacuum and Atmosphere Services Limited [2024] EWHC 2260 Acted for the defendant at a 5-day trial in a highly contentious Technology and Construction Court claim. The claimant sought damages in excess of £270,000 and was awarded less than £17,000.
- RGB P&C Limited v Victory House General Partner Limited [2019] EWHC 1188 (TCC). Successfully applied for summary judgment in relation to a construction final account adjudication dispute, defeating arguments alleging a breach of natural justice on the part of the adjudicator.
- Advised a listed Scandinavian construction company on its litigation risk following allegations of defective works arising from the manufacture and installation of cladding on a hospital in Salford, Manchester. The employer alleged that the entirety of the cladding needed replacing at a cost of c£4.5million. The case involved numerous complex expert reports on the cause of the alleged defects and jurisdictional issues. After negotiation, our client walked away without making any payments.
- Represented a specialist engineering practice defending allegations in multi-party litigation surrounding an incident in a lab at the University of Manchester.
- Successfully defended allegations made by the liquidator of a company against the former directors for misfeasance.
George is a litigation partner in our Sutton Coldfield office. George Green is the only Tier 1 ranked firm for litigation in Sutton Coldfield.
George is married with three young children. When he is not looking after his young family, George enjoys the great outdoors and is an active member in his local church.
