What options are available to resolve a family dispute?

There are numerous issues that arise following the breakdown of a relationship or marriage, including but not limited to divorce proceedings, child arrangements and financial arrangements. There are various options available to help resolve the issues and there is not a ‘one size fits all’ approach.

You may be able to resolve your disputes by one of the following methods:

·       Privately between yourself and your ex-partner, with assistance from a solicitor to prepare the agreement you have reached into a court order (also known as a “consent order”).

·       By attempting mediation to discuss the issues with your ex-partner and try to reach solutions.

·       By negotiating via solicitor correspondence about the issues.

·       By having round table meetings with your ex-partner and solicitors present to discuss the issues on a without prejudice basis.

·       By seeking use of a private evaluation of your case by a judge at the outset for an early judicial opinion.

·       By issuing court proceeds for the assistance of the court to make an order on the issues in dispute.

Our expert family lawyers will be able to signpost you to the best options available for your case. Each case is unique and we can advise on the most appropriate method based on your circumstances.
