There is a misconception that financial claims that spouses have in respect of the other automatically come to an end once the Decree Absolute has been granted. This is not the case, any agreement regarding financial matters should instead be reflected in a financial order and this should formally dismiss any future claims. 

 

  1. Remarrying before financial matters have been resolved

Remarrying before a financial order has been put in place with a former spouse may prevent the individual from bringing financial claims against their former spouse. 

 

  1. Disregarding pension assets

Pension assets may make up a substantial part of a separating couples finances and to disregard these could leave one party in a seriously disadvantaged position.
