How long does a divorce take?

Divorcing your ex can be a lengthy process. The new no-fault divorce involves obtaining a conditional order, then a final order to complete your divorce. Both orders can be applied for online without the need to prove fault for the break-down of the marriage.

The first step to beginning your divorce is to apply through the government portal. Your ex will need to acknowledge the divorce before it can begin to move to the next stage. You will then enter a waiting period of 20 weeks beginning from the date that your application was issued. During this, you should begin to organise your finances and child arrangements. Negotiations can become extensive; therefore, you want to ensure there is plenty of time to have everything in order before your divorce is finalised.

After this period, you will be eligible to apply for the conditional order. This is only the first divorce order; you will remain married to your ex until the final order is made. It will take 6 weeks and 1 day before you will become eligible to apply for the final order. If you have not reached a financial settlement with your ex before you are able to apply for the final order, then you may be better financially placed waiting until your finances have been resolved.

The timescales of the process mean the quickest a divorce can conclude is 26 weeks.
