Can I take my child on holiday abroad without the other parent's consent?

No, to take your child on holiday abroad, you have to get the permission of everyone with parental responsibility for a child. If the other person/parties with parental responsibility do not give their permission, you may need to apply to the court for permission.

 

If the other party/parent provides their consent for you to take a child on holiday abroad, you should try to obtain this in writing.

 

You should try to seek the agreement of the other party. If the other party is not willing to engage, you can try other avenues outside of court such as mediation or negotiation between solicitors, before you apply to the court for permission.

 

If matters do not resolve outside of court, you may need to apply for a specific issue order. A specific issue order can ask the court to decide on whether one parent should be allowed to take the child on holiday abroad. You should provide the court with details of the trip such as where you’re staying, and details of flights. You should also lodge with the court relevant evidence of attempts made to negotiate between you and the other party.
