Overview of Paul’s practice

Paul joined George Green in October 2014. He has been dealing with commercial property transactions for over 30 years and has a wealth of experience acting for a wide range of clients, including developers, investors, lenders, housing associations and charities, and individual and corporate landlords and tenants.

He has particular expertise in residential development transactions, acting for both landowners and developers in all aspects of the development process, ranging from conditional and unconditional contracts, option and promotion agreements and overage arrangements to planning, highways and utility agreements.

Recent Experience

Acting for the lender in connection with the provision of a facility to enable the developer borrower to complete its acquisition and then prepare for development of a prime residential property in central London. Security was taken not just over the property being acquired, but also two other properties, including a mixed use block comprising of over a 100 residential leasehold properties and commercial units.

Acting for the homeowners in the preparation and exchange of a suite of development documentation  relating to the development of their home and land adjoining it for development as residential units,  with agreed percentages of sale proceeds from plot sales on the development to be paid to our clients as the development progressed, the land being charged to our clients in the interim. The transaction also involved the negotiation and completion of the relevant section 106 Town and Country Planning Act 1990 agreement.

Acting for a local borrower in connection with the refinancing of its business operations, to enable finance to be provided by an alternative development funder in place of a High Street bank.

Acting for a local housebuilder in connection with its acquisition of a development site, then to be developed for the sale of 40 homes, to a mix of private for sale buyers and an affordable housing provider.  We dealt with the site from start to finish of the development process, including the conditional purchase contract, initial charge back to the seller of the site to our client while some of the price was deferred, overage arrangements with the seller, the planning and highways agreements affecting the site,  grant of easements to utility providers, preparation and completion of the golden brick arrangements with the affordable housing provider, plot sales to individual plot buyers, and transfer of the common parts of the estate to a residential management company.

Acting for a local college in the acquisition of properties from which a local arts and design college was operating, including a leasehold property and then the main site (made up of a mixture of freehold and leasehold interests), subject to a variety of pre-emption and option rights, for continued use of the site for educational purposes.

Acting in connection with acquisition of a residential development site from the HCA with the benefit of planning permission for 70 homes.

Acting in connection with the sale of a multi-let local industrial estate.
