Can I Stop My Divorce?

George Green’s Family Solicitors have been frequently asked by clients whether they are able to stop their divorce. The answer given will depend upon whether the client is the Petitioner or the Respondent in the divorce.

If they are the Petitioner in divorce proceedings and they have reconciled with their spouse they are able to withdraw their divorce proceedings up until their Decree Absolute (which formally ends the marriage) has been granted.

If they are the Respondent they are not able to withdraw the proceedings themselves but could apply to contest them. However, this is a lengthy and extremely costly process with perhaps (dependent on the circumstances) limited chances of success.

There are, however, other options available if a Respondent is concerned by the contents of a divorce petition or if they do not feel that they are the party at fault.
