Can a divorce be expedited if the applicant has a terminal illness?

From applying for the divorce to finalising the divorce, the process can typically take a minimum of 26 weeks. The parties will need to wait 20 weeks from their divorce application until they can apply for a conditional order. After that, they will need to wait a further 6 weeks before they can apply for the final order to complete the divorce.

In exceptional circumstances, this time period for a divorce can be shortened. A terminal illness may be a sufficient reason for the court to grant a shortened divorce process.

The party wishing to speed-up the process will need to apply to expedite the divorce with evidence in support. The court will then consider the circumstances and judge whether to grant to expedition.
