My ex has been abusive and I am worried about becoming homeless. What can I do?

If you have suffered domestic violence and you are worried about having a safe place to live, we can apply to the court for an Occupation Order to regulate the occupation of the family home.

The court has the power to order the respondent to leave the family home, and to exclude the respondent from a defined area in which the home is situated.

It is possible to make emergency applications whereby the court can grant the order within 24 hours.

The local authority can also assist if you are homeless or threatened with homelessness. The local authority has a duty to provide temporary housing for a homeless person with a priority need who did not become homeless intentionally. Domestic violence will satisfy the requirements to be a ‘priority need’.
