Do Harry and Meghan have a prenup?

Unfortunately unless Harry or Meghan choose to tell the world we will probably never know. Prenuptial agreements are private documents, they are not a matter of public record and are not done through the courts. There is therefore no record of them, other than with the parties themselves and their lawyers.

Prenuptial agreements are however becoming increasing common and are not just for royalty or the super rich. They are instead a very sensible insurance policy when a person is bringing assets into a marriage. This may be something as simple as having some equity your home, perhaps that was gifted from parents, or having built up investments, pensions or a business prior to the marriage. The starting point on a divorce is that all assets owned by either party are divided equally and this is especially true of the family home, regardless of in whose name it is owned. Many people are now getting married later in life or for the second time round and simply want to preserve the assets they brought into the marriage should the worst happen.  Prenuptial agreements ensure that everyone knows where they stand from the outset and reduce conflict in the event of a divorce. They can also be varied during the marriage should circumstances change.
