What is a conditional order in divorce proceedings?

A conditional order confirms that the court does not see any reason why you cannot divorce. This was previously known as a Decree Nisi.

An applicant can apply for a conditional order 20 weeks after their divorce application has been issued.

If the judge agrees with the application, the court will send a certificate that confirms the date on which the conditional order will be granted.

The conditional order does not bring the marriage to an end. The divorce will only be finalised once a final order of divorce has been made. The applicant (or joint applicants) must wait 6 weeks and 1 day after their conditional order has been granted before they can apply for a final order of divorce.
