Our Head of Department’s role as a part-time employment judge puts us in a strong position to advise employers locally regarding their obligations in the employment tribunal and their prospects of success. Although numbers of tribunal claims have dropped sharply since July 2013 when employment tribunals fees came into force, there is still a significant risk that an employer will be subject to an employment tribunal claim if it acts unfairly towards an employee.
In the event that an employer does act unfairly, an employment tribunal can not only order the employer to pay the employee's tribunal fees but can also award a financial penalty of up to £5,000 where a tribunal concludes that the employer has breached any of the workers’ rights and there are one or more “aggravating features”.
