Why make a Prenuptial Agreement?

When a couple marries, they unsurprisingly do not wish to contemplate the idea of separation and naturally believe that they will remain married for life. However, in reality marriage breakdowns and divorce are common place in today’s society.

Making a prenuptial agreement before a couple marries means that they are likely to have more control over what will happen to their finances and their assets in the event that their marriage does breakdown.

Whilst pre-nuptial agreements are, as the law stands, not legally binding in England and Wales there has been growing recognition of these agreements and as a result the courts are now more likely to follow the terms of an agreement providing that this has been entered into properly and correctly drafted.
