No fault divorce is coming

Justice Secretary David Gauke has confirmed that legislation will be enacted in the next session of parliament to allow for a no-fault divorce. This means that separating couples will no longer need to allocate blame in the petition or wait for years to divorce.

Current legislation means that anyone seeking a divorce must either prove fault through adultery, unreasonable behaviour or desertion. Or alternatively they must wait for 2 years of separation to have passed or 5 years if there is no consent to the divorce. This reform will therefore drastically change divorce law in the UK.

This change has been welcomed by practitioners after an overwhelmingly positive response to the reform consultation.
