My husband/wife owns our family home in their sole name. How can I protect my interest?

For some married couples, the family home is owned in the sole name of either the husband or the wife.

If the couple were to separate, the spouse not named as a legal owner of the property may feel vulnerable and may be concerned about what their husband or wife may be able to do to the property without their knowledge.

At George Green LLP our Family Law Solicitors regularly advise client’s in these circumstances as to how to protect their position. In particular, we assist in preparing the necessary application to the Land Registry which helps to ensure that the property cannot be sold, for example, without the non-owning party’s knowledge.

The necessary application is often referred to as “registering the matrimonial home rights”. If you would like more information or assistance with such an application, then please contact Alex Mansfield on 01902 328365 or at amansfield@georgegreen.co.uk.
