Can I force a sale of our house?

A married couple’s home is often central to family life and, in most cases, will be their main asset. When couples decide to divorce the question of what should happen to that home will often be a key decision to be made and in some cases can be a contentious issue.

Often the property will be in the joint names of both of the parties, requiring both of their approvals before the property can be sold. 

If either the husband or wife refuse to give their consent to a sale of the property, the other party will need to make an application to the Court to ask a Judge to order that the property be sold. 

The Court will take into account a number of considerations when deciding whether to order a sale; their primary concern being any children of the family and ensuring that their housing needs are met. They will also consider the needs of both of the parties as well as the other assets involved in the case.
