Why can't I divorce my spouse straight away without alleging fault?

It is very unfortunate that under the law of England and Wales as is currently stands you have to allege fault in order to obtain a divorce unless you are prepared to wait for 2 years and have the consent of your spouse. 

This means that for the other party the divorce usually starts with them either being asked to confirm that they have committed adultery or reading a list of their transgressions in the eyes of their erstwhile partner.  It really is a far from ideal way to start a process that is already fraught with emotion and, often, outright hostility.  

A bill introducing “no fault” divorces has recently passed its first hurdle in the commons.  This is good news, but there is long way to go before this become enshrined in law and available for married couples to take advantage of.
