Divorce (Financial Provision) Bill

This Bill received its second reading on 27 January 2017.  It proposes to amend section 25(2) of the Matrimonial Causes Act 1973.  

The purpose of this private member’s Bill is said to be ‘to reform the law relating to the splitting of assets on divorce.’ The criticism levelled at the current legal position is that the level of judicial discretion has led to unpredictability and conflicting decisions which make it harder for the parties to negotiate. The Bill would implement provisions that are similar to those found under Scottish law. If enacted the scope for a wide variation in possible outcomes on a similar fact pattern should be significantly reduced.  It also seeks to make prenuptial agreements legally binding.
